Trust question on a listing

Question:

I am getting ready to list a home. The couple is getting divorced. They have gone to mediation and agreed upon a settlement. The home is in their trust but the husband is getting the home in the divorce settlement. The divorce is not final. Who will be the seller of the home? Who needs to sign the Listing Agreement, just the husband? Thank you

Answer:

If it’s in a trust the Trustee should sign.  If the Trust is being modified, you will need the Court order, or Divorce agreement for the Title Co.   Title will need a copy of Trust before settlement. But basically the party on Title must sign the agreement.
