Realtor® Legal Tip – Don’t access the home unless you have authorization from the listing agent.
I just read over 3 ethics cases that were filed here at the Board. All 3 of these cases involved an agent entering a home with their buyer without permission from the listing agent or seller. In some cases the seller was startled late at night when someone was trying to come in the home. In all 3 cases the agents were found in violation of the ethics rules.
Be sure to follow any showing instructions on the MLS before entering a home.
Also, listing agents, please respond as quickly as possible when you receive a showing request.
Remember most listings are occupied. Lock boxes can be on timers however listing agent may not have set them correctly. It’s just good practice to notify listing agent of intent to show.
