Does the Acceptance box need to be checked?

RealtorĀ® Legal Tip – Does it matter if the “Acceptance” box is left blank when accepting an offer or counter offer?

Yes!

This is a simple one but I’ve been hearing some agents say that it doesn’t matter if the “Acceptance” box is left unchecked when their client accepts the offer as long as it’s signed. While the signature is certainly the most important, leaving the box blank and unchecked is not only sloppy work but also can create legal problems if one of the parties decides to challenge the contract later on.

My view has always been to be very specific when filling out contracts so there is no room for debate or disagreement later on during the transaction. As an industry we all need to continue to raise the level of professionalism and represent our clients to the best of our ability.
